Abstract
In the field of industrial property, pharmaceutical patents constitute a temporary exclusivity that protects innovation, incentivizes research, and promotes investment in new medicines. Their validity entails legal, social, and economic effects, since, once they fall into the public domain, they allow the entry of generic medicines that reduce costs, expand healthcare coverage, and strengthen national production, contributing to a more competitive and self-sufficient market. Faced with the massive expiration of patents anticipated by the government, there arises the need for a comprehensive pharmaceutical policy that combines the protection of public health with economic development.
